Quotes and Estimates
Quotes and estimates are valid for 30 days from date of the document unless otherwise noted.
All sales and work performed are expressly conditioned on Buyer’s agreement to the terms and conditions on estimates, quotations, service reports, and repair orders from Power Systems Plus, Inc., hereafter referred to as Seller.
No additional or different terms apply unless expressly agreed to by Seller in writing.
Acceptance of or payment of goods constitutes Buyers agreement to Sellers terms and conditions.
Explanation Of Property Owner Rights
Consumers have the right to receive the products and services agreed to in the contract.
Consumers have the right to resolve disputes through means outlined in the contract.
Consumers have the right to file a complaint with the CCB. Any arbitration or mediation clauses in the contract may need.
to be complied with during the resolution of the CCB complaint.
Unless otherwise specified on an estimate, quotation, or letter, terms are due upon receipt or net thirty (30) days, subject to approved credit, payable in U.S.
Title and risk of loss pass to Buyer upon delivery.
Invoices not paid in accordance with terms are subject to interest charges at the rate of 1 1⁄2 percent per month unless prohibited by law, in which event invoices will be subject to interest charges at the maximum legal contract rate.
Minimum invoice interest charge is $15.00.
Materials may not be returned without the prior approval of Seller.
Transportation costs are to be paid by the Buyer.
Seller assumes no responsibility for accepting goods for credit or exchange, but may do so in specific cases for certain standard unused and unaltered items when agreed to by authorized factory personnel: where goods are accepted for credit or exchange, a twenty (20) percent restocking fee will be imposed.
In the event that payment under the terms of this agreement becomes delinquent, you agree to pay Power Systems Plus all cost associated with the collection of your account including reasonable attorney fees, court cost and fees charged by a third party collection agency.
Power Systems Plus reserves the right to maritime liens for all necessaries.
Attorney’s Fees and Venue
In any action between Buyer and Seller, if Seller is the prevailing party, Seller will be entitled to recover its reasonable attorney’s fees and expenses including fees incurred in arbitration mediation, at trial, on appeal or post-judgment.
Any provision in any final judgment rendered in favor of Seller will contain a provision allowing for later assessment of attorney’s fees and cost incurred in the collection of any judgment.
If Buyer does not satisfy the judgment when entered, all past due amounts are subject to a service charge of 1 1⁄2 percent per month or the maximum lawful contract rate.
The venue of all actions between Buyer and Seller will be in a court of competent jurisdiction in Washington County, Oregon.
Buyer consents to the jurisdiction of the courts of the State of Oregon and specifically waives any right to trial by jury in any action brought by or against Buyer.
The law of the State of Oregon shall govern the right of Seller and Buyer under this agreement.
